The State appeals a decision suppressing methamphetamine found in a search incident to Daniel Martinezs arrest for driving with a suspended license. Relying on City of Redmond v. Moore, 151 Wn.2d 664, 91 P.3d 975 (2004), the trial court ruled that Martinezs license had been suspended under an unconstitutional statute, and therefore the arrest and search were unlawful. The courts decision effectively terminated the prosecution.
